Terms of Service

These Terms govern your use of AfterContext — the CRM and API at aftercontext.com that gives AI agents a permanent memory. By creating an account or using the service, you agree to them. If you are accepting on behalf of a company, you confirm you are authorized to bind it.

1. The service

AfterContext lets you and your AI agents store and retrieve CRM records (companies, contacts, opportunities, tasks, activities, and notes) through an HTTP and MCP API and a web dashboard. We may add, change, or remove features over time. Your use of the service is also subject to our Privacy Policy.

2. Accounts and API keys

  • You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and API keys, including actions taken by AI agents you connect.
  • API keys are bearer credentials: anyone holding a key can act as you. Protect them, rotate them, and revoke any key you believe is exposed. We are not liable for activity arising from a key you failed to keep confidential.
  • You must be at least 16 and not barred from using the service under applicable law.

3. Acceptable use

You agree not to:

  • break the law, infringe others’ rights, or store data you have no right to store;
  • upload unlawful content or personal data you are not permitted to process;
  • probe, attack, overload, or attempt to bypass the security, isolation, or rate limits of the service;
  • resell or expose the API as a competing service, or attempt to access another tenant’s data.

We may suspend or terminate accounts that violate this section, that create security or legal risk, or that fail to pay.

4. Your data and responsibilities

You own the records you put into AfterContext, and you keep all rights to them. You grant us the limited rights needed to host, process, transmit, back up, and display that content so we can operate the service for you. As between us, you are the controller of your CRM content and you are responsible for its legality — including having any consent or legal basis required to store information about your customers and contacts, and for honoring their rights. You are responsible for keeping your own copies; the export tools are provided so you can do so.

5. Billing

Paid plans and top-up packs are billed through Stripe. Plans renew automatically until cancelled; usage allowances are enforced as hard stops, so an agent cannot run up metered overage you did not approve. Fees are non-refundable except where required by law. We may change pricing prospectively with notice; changes do not affect the period already paid.

6. Service availability — no guarantee

We work to keep AfterContext available and reliable, but the service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or perfectly durable operation, and we may perform maintenance or impose limits. You are responsible for maintaining independent backups of any data that matters to you.

7. Security and data breaches

We apply reasonable, industry-standard safeguards to protect your data — TLS in transit, hashed passwords and API keys, and per-account data isolation. However, no method of transmission or storage is completely secure, and we cannot and do not guarantee that the service or your data will be free from unauthorized access, breach, loss, corruption, or interception. You acknowledge that you provide your data at your own risk.

To the maximum extent permitted by law, AfterContext is not liable for any loss, damage, claim, or expense arising out of or relating to any security incident, data breach, unauthorized access, data loss, corruption, or disclosure — whether or not such incident results from a failure of our safeguards — except to the extent it is caused by our gross negligence or willful misconduct and only subject to the limits in Section 9.

If we become aware of a breach affecting your personal data, we will notify you as required by applicable law. In the event of an incident, your sole remedy and our entire obligation is to investigate and take reasonable remedial steps, subject to Sections 8 and 9.

8. Disclaimer of warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, secure, accurate, or error-free. No advice or information obtained from us creates any warranty not stated here.

9. Limitation of liability

To the maximum extent permitted by law, AfterContext and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the service or these Terms, even if advised of the possibility of such damages, and whether the claim is based in contract, tort, strict liability, or otherwise.

Our total aggregate liability for all claims relating to the service or these Terms is limited to the greater of (a) the total fees you paid to us for the service in the three (3) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain exclusions or limitations; in those places the above applies to the fullest extent permitted, and nothing in these Terms limits liability that cannot be limited by law.

10. Indemnification

You will defend and indemnify AfterContext against claims, damages, and costs arising from the content you store, your use of the service, or your breach of these Terms or of any law or third-party right.

11. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access for breach, non-payment, or to protect the service or other users. On termination, your right to use the service ends; provisions that by their nature should survive (including Sections 4, 6–10, and 12) survive. We handle data after termination as described in the Privacy Policy.

12. Governing law and disputes

These Terms are governed by the laws applicable at AfterContext’s principal place of business, without regard to conflict-of-laws rules, and the courts there have exclusive jurisdiction, except where mandatory local law gives you other rights. Any claim must be brought within one (1) year after it arises.

13. Changes to these Terms

We may update these Terms as the service evolves. When changes are material we will revise the effective date above and, where appropriate, notify you. Continued use after changes take effect means you accept them.
